
I am on a university project at wwu.Myself and four other employees of a subcontractor have not been paid for one mo. The Sub went under and the general is dragging his feet and not covering our pay.Can we call in his bond to get our back pay.All of the big players have been recieving thier draws and the general has tons of money and is a union general contractor.We are non union but prevailing wage.46.16 per hour.This is a consideral amount of money and we are getting desperate.L. and I. would take too long and they have no teeth in recovering wages.our combined moneys due exceed 30,000.
If the bond covers us how do we locate the bonding agent and how do we get them to honor thier bond?
If the university required a performance and payment bond then you may be guaranteed payment under the payment portion of the bond.
I would start by telling the contractor you plan on filing a claim on their bond.
In today's bond market I can almost guarantee that they had to indemnify corporately and personally (including their spouses). In other words, they signed an agreement that states they will pay for any claims and legal fees incurred by a claim on the job. This should be good motivation to get them moving. Set a deadline within a certain amount of business days and require a wire transfer to your account (this will prevent the possibility of a bounced check).
If they still do not comply, contact the university to let them know they aren't paying their subs.
