I went to small claims court against a legal document assistant and won a judgment (she didn't show up!). I'm not sure if she has the required bond or not (I'm still trying to find out with the LA County Recorder's office). I took her to court because she never provided me with the information I paid her to provide me with...in fact, she never provided me with anything at all...just excuses or silence. My question is should I be able to get the judgment from her bond for the reason I stated or does the bond only cover certain other things?
Thanks!
Carolina
Are you positive the court required a bond?
If so, In all likelihood, the bond was required of her by the courts in case she does not pay. If this is the case, you can file a claim on the bond if you can not collect.
I live in San Diego County. Check with County Clerk's office. If she posted a bond, it must be kept on record for a specified period of years. The bond will be in favor of the State of California who holds the money on your behalf. Definitely try calling the County Recorder's office to see if a bond was recorded.
