The Legal Document Assistant’s Bond is a peculiar little instrument that must be filed with the county clerk when a person (or partnership or corporation) registers as a legal document assistant or as an unlawful detainer assistant. The amount of the bond ranges from $25,000.00 for an individual up to $100,000.00, depending on how many assistants are employed. The field is regulated by sections 6400-6415 of the California Business and Professions Code. There is not, however, a specific board or commission that regulates the field. The obligation of the bond is limited to direct pecuniary loss that arises from the principal’s “unauthorized practice of law.” While it sounds pretty narrow, it is difficult to define when an assistant’s services have gone beyond mere document preparation and entered the realm of unauthorized practice.
