Default Bmc-85

I opened a moving company and I was in the process of getting quotes for a BMC 85 bond, I don't own any property, I have a 587 credit score and I have nothing to use as collateral.

Do I still need a BMC 85 bond if the moves are pretty much self load moves? If not, under what type of license do I register with the FMCSA.

I provide the truck and the driver and the customer does the loading and unloading.

Also, if I were to get a BMC 85 can you assist me with a company telephone number that I can call to get one, regardless of if I need one or not for the self load?

The question is, are these your trucks or are you hiring trucks as sub-contractors?

The FMCSA has very strict guidelines when you are dealing with John Q. Public as the consumer.

If you are hiring as sub-contractors, you will need to get household goods broker authority and yes you will need a BMC-84 Broker Bond or a BMC-85 Broker Trust Fund.

This coverage is to make sure you pay your trucks.

Default Not My Trucks

I sub-contracted the job to a carrier. Now this carrier is holding my customers belongings hostage for 40 days and has taken all the money in cash from my customer so I have no leverage and I have no bond so if I get caught without a bond and I have already sub-contracted a job out, what happens to me legally? The carrier will not release anything to me as the broker because he is worried that there will be a lawsuit against him if he does release it and then has nothing to levy with later.

It is one big mess! That carrier only did two jobs for me and both of my cutomers have had to take legal action because of him.

Since then, I contract with a freight company to do all my pick ups Nationwide and I hire local laborers to ensure the loading and unloading for my clients because moving carriers are so crooked I don't have the energy to deal with their lies and how they rob consumers left and right. I am not in agreement with that and it is not the reason I got into this business. I actually got into it to try and beat those carriers out of thier own game. I can not only guarantee a price, but I can guarantee an exact time of pick up and delivery along with delivery dates guaranteed as well. It's fast service, great prices and no scams.

Do you know what type of license I need if I am using a freight company to do my pick ups?

This IS a big mess! This is exactly what I was referring to in the previous post about the dealing with the public.

You were operating without household goods broker authority, your customer did not verify your legality, and now you have a crooked carrier taking advantage of the situation! The carrier is probably wanting more $ because they say you under estimated the cost, space,time etc!

You need to settle this with the carrier...fast.
I strongly recommend you get broker authority before you do any more moves.

The FMCSA is cracking down hard on these type of operations because like this case, John Q Public is getting taking advantage of.
