Default claims on a title company's surety bond

Under Texas law, must a title company (involved in fraud, dishonesty and various breaches of fiducary duties) be insolvent for a party to make a claim on the title company's surety bond?

No.
Anyone can make a [U]valid claim under a bond at any time while the bond is in force. It does not matter if the corporation is insolvent or not.
