Is there an company that will help me get an bond with bad credit. I have to pay her bills but can not access her accounts to do so. My mom passed away 2-11-04 and had a will (not Living Trust).  Years ago due to a nightmare divorce her atty advised removing my name from house, ckg etc.  So my deceased father's sister was choosen as executor.  Right before my mom turned critically ill - she spoke with her sister-in-law (executor) who was due to have major surgery and had concerns about being able to adminster the estate and my mom's sister who lives in Oregon offered. Before I forget, my father's sister, my mother and myself are Calif residents.

Anyway, the change in executor occurred after my mother died.  All was well and fine and I was grateful to my aunt taking on the duties as having lost my father and two sisters and then my mom - I was totally in a fog.  

A year goes by and all the acctg had been completed with the exception of the 2003 Income Taxes being filed and signed by my aunt and the form waiving the Administrator or Executor Fee.  Which I told my aunt she was entitled to and she would not hear of it and verbally told the atty and myself she would waive the fee.  This brings us up to March 2005 (mom passed away Feb. 2004) then my aunt unexpectedly dies. (March 15, 2005)  

My cousins who have more money than they know what to do with are now saying their mother never mentioned anything about waiving the fee to them.  That got me to thinking- in my fog I recall signing some forms and I am now wondering if one of those was a waiver for a surety bond that could or would have been required of my aunt as executor (see and you were wondering why I was posting to this forum huh ).

With my aunts passing prior to the completion of probate and my greedy cousins now jumping into the picture and if the atty handling the probate ever bothers to *request * a new court date to have me appointed as the new executor  (and I am sole heir)  where at this point of this nightmare does or would a bond play a part???

I have made calls to the attorney but she always passes my calls off to her paralegal and in the past year she has lost two paralegals and is now on #3 and is brand new.  Needless to say I'm frustrated, so here I am.

we are starting to do the paper work in regards to my father estate.
We are not using a lawyer, and we have narrow down that the debt is 10,000 based on our inquires and the estate is small at 30,000.


we were told by the clerk that there may be a possibility that we may need to have a "surety" bond. For the fact that we know there are debts to my dad and he said we may have overlooked other debts.

Question is:
What is a "surety bond"? What is the procedures and penalties for having one?
I'm used to hearing bond when your're arrested, so this is new to us.

I am listed as a beneficiary in her will and I received a notice in the mail today from the circuit court in her county, notifying me that her will is being admitted to probate and that her nephew is personal representative. My question is, in the notice it states that her nephew is "entering into bond in the sum of $230,000. I assume this is a court ordered probate bond (even though her will stated no bond is required of her personal representative). Does this mean that the total value of her estate (including her real estate) is $230,000? Could the total value be less than that? Could the total value be more than that? Is real estate covered under the  probate bond or just liquid assets? Also I was told my aunt and uncle had combined their assets into a trust when they entered an assisted living facility...would the assets in the trust be included in the bond? I am not sure of what the purpose of the bond is...or what assets it covers...and the figure of $230,000 has me a bit confused since i am not sure if thats just what he took a bond for...or if thats the total value of the estate (everything my aunt owned, houses, property, bank acccounts, investments, the trust etc) Thanks so much for any help you can give me.]]></description>

The court requires that she be bonded, but apparently the bonding companies approached by our lawyer have said that they won't bond a non-resident (Catch 22).  Can anyone recommend a bonding company that will put up a bond for a non-resident of California???]]></description>
