Supersedeas bonds are also frequently called appeal bonds; language depends upon underlying statutes. The bond guarantees payment of the judgment being appealed by the loser as well as other costs associated with the process of doing so. Bond amount required is almost always more than the actual judgment although several states are considering legislation that would cap the amount required for super-sized awards. It's a pure financial guarantee and will require full collateral unless the applicant is financially very strong. However, in that case, be aware that collateral can frequently (but not always) be given directly to the Court.

Sorry, I didn't realize until too late that yours is actually a commercial site (I'd searched for "forums" on my yahoo business page)! Didn't mean to invade your territory. I've been either a bond agent or a bond underwriter for 20+ years, and married to an underwriter even before that. Focus has primarily been on the commercial side of the house, and I'm currently an underwriter with a top ten company. I'll stop posting but will continue to watch and read and be amazed at the amazing situations that arise - your forum is a good service to shed light in the darkness!
