    Probate Bonding Denial

    I am the administrator of my deceased husband's estate. He left no will or assets, property etc. Prior to his death he was a litigant in a class action suit for personal injury. This case is now beginning to settle. Monies are available to the estate to pay all the debts he left behind I was unable to pay. I have been instructed to obtain a bond for $100,000 but have been denied because of bad credit due to the all the debts my husband and I incurred together and have been unable to pay since his death. I am currently being garnished and have other judgements against me. What can I do?

    As an underwriter, I'd recommend hiring a probate attorney and have him act as co-principal for the bond. If the bond company sees that you're represented by legal counsel and that you'll be guided by his advice, you're far more likely to get a favorable response. Further, it's quite likely the attorney has a relationship with an agent who routinely writes his bonds, and by initiating the request through his office, that's another way to strengthen the submission.

    If you haven't already done so, go ahead and get a copy of your credit reports from the three bureaus, Experian, Equifax, and TransUnion, just to verify their accuracy (reports will be free of charge because of the credit declinations you've received).
